TwinTone Terms of Service
Effective date: 10 August 2026
These Terms of Service ("Terms") govern your access to and use of the TwinTone platform (the "Service"), operated by TwinTone, a New Zealand-based company ("TwinTone", "we", "us", or "our"). The Service is available at live.twintone.ai, with information at www.twintone.ai.
By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of a company or other organisation, you represent that you have authority to bind that organisation.
1. The Service
TwinTone is an AI live-streaming platform. You connect your brand website and, where applicable, your product catalog, and TwinTone generates an AI avatar that live-streams on your behalf — presenting products, engaging viewers, and answering chat — around the clock, across the streaming channels you choose.
We may modify, suspend, or discontinue parts of the Service at any time, and may update these Terms by posting a revised version at www.twintone.ai/terms-of-service.
2. Accounts
- You must provide accurate, current account information and keep it up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You must be at least 18 years old and, if using the Service on behalf of a business, authorised to do so.
- You must notify us immediately of any unauthorised use of your account at legal@twintone.ai.
- You are responsible for all content generated and all streams conducted under your account.
3. Your responsibilities — you are the publisher
The AI host speaks on your behalf, on your channels, to your audience, about your products. Accordingly:
- You are solely responsible for the content of your streams and for compliance with all applicable laws and regulations — including gambling advertising, consumer protection, advertising standards, and data protection — in every jurisdiction where your streams are available.
- You are responsible for determining the legality of your streams in each target market. Gambling-related streaming is restricted or prohibited in some jurisdictions; you must ensure your use is lawful wherever you operate.
- You warrant that you own or are licensed to use all games, products, brand assets, and content featured in your streams, and that your use does not infringe any third party's rights.
- If you use the human-replica feature, you must obtain and maintain a signed likeness and voice release from any individual whose face, voice, or likeness is replicated, and provide it to us on request. We may refuse to create or continue a replica absent a valid release.
4. Acceptable use
You agree not to use the Service to:
- create, stream, or distribute content that is unlawful, fraudulent, defamatory, hateful, or that infringes any third party's rights;
- send spam, engage in deceptive marketing, or misrepresent your identity or products;
- stream content that violates the terms or policies of any streaming platform or channel you connect;
- interfere with, disrupt, or attempt to gain unauthorised access to the Service or its systems;
- reverse engineer, copy, or resell the Service or its components;
- use the Service to train competing models or extract its underlying technology; or
- assist or encourage anyone else to do any of the above.
We may moderate or remove content that violates these Terms, and we may suspend or terminate accounts that abuse the Service.
5. AI-generated content and compliance tooling
- TwinTone provides automated moderation and compliance tooling (including rules-based filtering, LLM safety checks, blocked-phrase lists, and configurable responsible-gambling disclaimers) designed to reduce policy violations.
- This tooling is provided on a best-efforts basis. We do not warrant or guarantee that any stream will comply with applicable law or platform rules. AI-generated content is produced by machine-learning models and may be inaccurate or inappropriate. You are responsible for reviewing and supervising your streams.
- Streaming platforms may change their policies or restrict AI-generated content at any time. We do not warrant continued compatibility with any platform and are not liable for platform enforcement actions (including account suspension or termination).
6. Billing and subscriptions
- Fees for the Service are set out on our pricing page or in your order or agreement, and are payable as described there (for example, monthly plans, prepaid hour packages, or metered usage).
- Usage-based fees are calculated from metered usage of the Service, such as streamed hours or API minutes.
- Payments are processed by Stripe. You authorise us (or Stripe on our behalf) to charge the payment method on file. If a payment fails, we may suspend access until the balance is settled.
- Unless otherwise stated, fees are exclusive of taxes, which you are responsible for paying.
- Except as required by law or as set out in your order, fees are non-refundable. Any trial or promotional period is subject to its stated terms.
7. API usage
If you use our API or MCP integrations:
- Access is subject to the applicable plan and documented limits, including rate limits and metered pricing.
- You must not attempt to exceed or circumvent usage limits, or use the API in a way that degrades the Service for others.
- API documentation is available at live.twintone.ai and may change as we improve the Service; we will use reasonable efforts to notify you of material changes.
8. Intellectual property
- Your content. You retain all rights to the brand content, product data, and materials you provide. You grant TwinTone a non-exclusive, royalty-free licence to use that content to provide, operate, and improve the Service for you.
- Our property. The Service — including its software, AI models, design, branding, and documentation — is owned by TwinTone and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms. Unless otherwise agreed in writing, AI avatars and stream templates created for you are licensed for use with the Service and may not be used to build competing services.
- Feedback. Suggestions or feedback you provide about the Service may be used by us freely.
9. Termination
- You may stop using the Service and close your account at any time by contacting legal@twintone.ai or using the account settings.
- We may suspend or terminate your access immediately if you breach these Terms, violate applicable law or platform rules, or engage in conduct that threatens the Service or other users.
- Upon termination: your access ends, your rights under these Terms lapse, and we will delete or de-identify your personal information in line with our Privacy Policy (unless we must retain it by law). Prepaid fees are forfeited unless otherwise provided in your order; fees for services already rendered remain payable.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that AI-generated content will be accurate, appropriate, or compliant with applicable law or platform rules.
11. Limitation of liability
To the maximum extent permitted by law:
- Our aggregate liability arising out of or relating to these Terms or the Service shall not exceed the fees paid by you to TwinTone in the twelve (12) months preceding the event giving rise to the claim.
- We are not liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, loss of data, regulatory fines, or platform account suspension — even if advised of the possibility of such damages.
- Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless TwinTone and its officers, employees, and agents from and against any claims, damages, and expenses (including legal fees) arising out of or relating to: (a) your use of the Service; (b) the content of your streams; (c) your products or business; (d) your violation of these Terms; or (e) your violation of applicable law or the rights of any third party. We provide no indemnification for claims arising from your content or regulatory non-compliance, except to the extent directly caused by our gross negligence or wilful misconduct.
13. Governing law and disputes
These Terms are governed by the laws of New Zealand. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of New Zealand, and you submit to that jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. The current version will always be posted at www.twintone.ai/terms-of-service with its effective date. Material changes will be communicated to you by email or in-app notice; continued use of the Service after changes take effect constitutes acceptance.
